Supreme Court dismisses plea for cancellation of CBSE compartment exams for Class XII and X
A three-Judge Bench of the Supreme Court comprising of Justices A M Khanwilkar, Justice Dinesh Maheshwari and Justice Sanjiv Khanna on 20 August 2020 dismissed a petition seeking the cancellation of CBSE compartment exams for Class X and XII in view of the COVID-19 pandemic situation.
A letter-petition was moved by 809 students from across India and urged the Supreme Court to take suo motu cognizance of the decision of the Central Board of Secondary Education (CBSE) to conduct compartment exams amid the COVID-19 crisis.
Alternatively, the petition had prayed for the declaration of the exam dates. CBSE conduct compartment exams for students who could not pass in one or two subjects in Class X or XII board exams. The CBSE gives three chances to such students to clear the compartment exam.
The letter had raised concern that while there is no update on the schedule of the compartment examination, most colleges have given examination deadlines.
The letter petition further averred that this decision of CBSE "exposes students/parents/teachers and staff to a lot of risk in view of exponential growth of the virus in the country".
Supreme Court while dismissing the plea moved by students to cancel the conduct of compartment exams, said that a separate substantive petition needs to be filed to assail the August 6 CBSE representation regarding compartmental exams.
