Supreme Court holds Advocate Prashant Bhushan guilty of contempt, hearing on sentence to be held on
The Supreme Court today found Advocate Prashant Bhushan guilty of contempt of court for his tweets regarding Chief Justice of India SA Bobde and functioning of the judiciary posted earlier this year.
In a suo moto contempt case, a three judges bench comprising Justices Arun Mishra, B.R. Gavai and Krishna Murari held civil rights Advocate Prashant Bhushan guilty of contempt. While pronouncing judgement, Hon’ble Justice B.R. Gavai stated that Mr. Prashant Bhushan has committed “serious contempt of court”.
The tweets in question were posted by Mr. Bhushan in july. The first tweet pertained to his comments on a photograph of Hon’ble CJI SA Bobde seated on a high-end motorcycle. In this tweet Prashant Bhushan stated:
"CJI rides a 50 Lakh motorcycle belonging to a BJP leader at Raj Bhavan Nagpur, without a mask or helmet, at a time when he keeps the SC in Lockdown mode denying citizens their fundamental right to access Justice!"
In the second tweet he commented on the role of Supreme Court and the last 4 CJI’s in the destruction of democracy. In this tweet he stated:
"When historians in future look back at the last 6 years to see how democracy has been destroyed in India even without a formal Emergency, they will particularly mark the role of the Supreme Court in this destruction, & more particularly the role of the last 4 CJIs."
On July 22 a three judges bench comprising Justices Arun Mishra, B.R. Gavai and Krishna Murari, and headed by Justice Arun Mishra issued contempt notice to Prashant Bhushan in a suo moto case with respect to these two of his tweets.
Hearing on sentence is to be held on August 20, 2020.
